Welcome to Abay Mart Trading PLC (“Abay Mart”, “we”, “us”, or “our”), a legally registered company in the Federal Democratic Republic of Ethiopia, operating e-commerce, retail, distribution, and digital marketplace services.

These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and services (collectively, the “Platform”).

By accessing or using our Platform, you agree to be bound by these Terms.

Abay Mart operates as:

• A direct seller of its own products
• A distributor and agent for partner companies
• A digital marketplace platform (current and future phases)

Products displayed on the Platform may be:

• Owned by Abay Mart
• Supplied by third-party vendors or partners

To use our services, you must:

• Be at least 18 years old or have legal capacity under Ethiopian law
• Provide accurate and complete information

We reserve the right to refuse service to anyone at our discretion.

4.1 Account Creation

You may be required to create an account to access certain services. You agree to:

• Provide accurate, current, and complete information
• Update your information as needed

4.2 Account Security

You are responsible for:

• Maintaining confidentiality of your account
• All activities under your account

5.1 Order Acceptance

All orders are subject to acceptance by Abay Mart. We may cancel or refuse orders due to:

• Product unavailability
• Pricing errors
• Suspected fraud

5.2 Pricing

• Prices are listed in Ethiopian Birr (ETB) unless otherwise stated
• Prices may change without prior notice
• Confirmed orders will honor the agreed price

We support multiple payment methods, including:

• Cash on Delivery (COD)
• Bank transfer / mobile money (e.g., Telebirr, CBE)
• Other digital payment systems as integrated

6.1 Payment Responsibility

Payment must be completed before order fulfillment unless COD is selected. Abay Mart may act as:

• Principal seller
• Intermediary (for third-party products)

7.1 Delivery

We arrange delivery through:

• Internal logistics
• Third-party delivery providers

7.2 Risk and Responsibility

Abay Mart remains responsible for the product until it is:

• Delivered to the customer
• Received in acceptable condition

8.1 Return Eligibility

Customers may request returns within 3–7 days (depending on product type), subject to:

• Product being unused
• Original packaging
• Proof of purchase

8.2 Non-Returnable Items

Certain items may not be eligible for return (e.g., hygiene products, customized items).

8.3 Refunds

Refunds will be:

• Processed after inspection
• Issued via original payment method or agreed alternative

For products supplied by third-party vendors:

• Product quality and authenticity are the responsibility of the supplier
• Abay Mart acts as a facilitator/intermediary
• Abay Mart will assist in dispute resolution but is not the manufacturer

You agree NOT to:

• Use the platform for illegal purposes
• Interfere with system operations
• Attempt unauthorized access
• Upload malicious content

Violation may result in account suspension or legal action.

All content on the Platform (logos, images, text, software) is:

• Owned by Abay Mart or licensed partners
• Protected under applicable intellectual property laws

You may not use or reproduce content without permission.

By using our Platform, you agree that we may collect and process your data, including:

• Name, phone number, and address
• Transaction data
• Device and usage data

Data is used for:

• Order processing
• Customer support
• Marketing and service improvement

We take reasonable measures to protect your data.

To the maximum extent permitted by Ethiopian law:

• Abay Mart shall not be liable for indirect or consequential damages
• Liability is limited to the value of the transaction

Nothing in these Terms excludes liability where it cannot be excluded under Ethiopian law.

The Platform and services are provided “as is” and “as available”.

We do not guarantee:

• Continuous availability
• Error-free operation

We reserve the right to:

• Suspend or terminate accounts
• Restrict access

If users violate these Terms or engage in harmful behavior.

These Terms are governed by the laws of:

• The Federal Democratic Republic of Ethiopia

In case of dispute:

• 1. Parties agree to attempt amicable resolution first
• 2. If unresolved, disputes shall be handled by competent Ethiopian courts

We may update these Terms at any time.

Updates will be:

• Posted on the Platform
• Effective upon publication

Continued use means acceptance of updated Terms.
